Clarion Borough police have charged five people with various felonies and misdemeanors stemming from an 8:20 p.m. March 18, 2019, assault in Clarion Borough.
Clarion Borough Police Chief William H. Peck IV said the investigation and charges were delayed after the original investigating police officer left the police department and the victim and defendants were difficult to track down.
The following charges were filed March 2 at District Judge Duane Quinn’s office by Clarion Borough Police Officer Mark Bettwy:
– Kierra Colligan, 20, Rural Valley.
Charged with conspiracy to commit aggravated assault, as a first-degree felony; conspiracy to commit aggravated assault, as a second-degree felony; one count each of riot to commit a felony, riot with a firearm or weapon, conspiracy to riot to commit felony and conspiracy to riot with a firearm or weapon, all third-degree felonies; simple assault and conspiracy to commit simple assault, both second-degree misdemeanors; disorderly conduct and conspiracy to commit disorderly conduct as third-degree misdemeanors; and summary charges of disorderly conduct, harassment and conspiracy to commit harassment.
– Brandon A. Anthony, 20, Kittanning, and:
– Lucas Robert Toy, 18, Kittanning.
Anthony and Lucas R. Toy are each charged with conspiracy to commit aggravated assault, as a first-degree felony; conspiracy to commit aggravated assault, as a second-degree felony; one count each of riot to commit a felony, riot with a firearm or weapon, conspiracy to riot to commit felony and conspiracy to riot with a firearm or weapon, all third-degree felonies; simple assault and conspiracy to commit simple assault, both second-degree misdemeanors; disorderly conduct and conspiracy to commit disorderly conduct as third-degree misdemeanors; and summary charges of harassment and conspiracy to commit harassment.
– Tiffany Ann Lamb, 19, New Bethlehem, and:
– Alexander Michael Toy, 20, Kittanning.
Lamb and Alexander M. Toy are each charged with conspiracy to commit aggravated assault and burglary as a first-degree felonies; conspiracy to commit aggravated assault, as a second-degree felony; one count each of riot to commit a felony, riot with a firearm or weapon, conspiracy to riot to commit felony and conspiracy to riot with a firearm or weapon, all third-degree felonies; simple assault and conspiracy to commit simple assault, both second-degree misdemeanors; disorderly conduct and conspiracy to commit disorderly conduct as third-degree misdemeanors; and summary charges of harassment, conspiracy to commit harassment and conspiracy to commit retail theft.
According to court documents, Lamb is the former girlfriend of the alleged male victim.
Lamb and the victim had broken up about two weeks before the incident and Lamb had belongings at the victim’s apartment she wanted to retrieve.
During the course of the investigation of the incident, police obtained video surveillance records from Walmart showing the group entering the store and picking out various items, including a metal baseball bat and some bandanas.
The group allegedly went through the self-checkout lane where Colligan allegedly scanned some items and not others, including the baseball bat.
The group then went to the victim’s apartment near Clarion University campus.
According to the victim, one of the defendants knocked on the door of the apartment and the door was answered by a friend of the victim.
Court documents contend one of the male defendants, using an empty pizza box, posed as a pizza delivery man.
The man who opened the door said he did not order a pizza and closed the door.
A few minutes later, Colligan allegedly knocked on the door and the victim answered the door.
Colligan allegedly asked the victim if he wanted to hang out with her and Lamb. The victim told police he told Colligan “No” and closed the door.
A few minutes later, there was a knock on the door and the victim again opened the door.
This time, the victim told police, he was sprayed with pepper spray and dragged outside the apartment where Alexander Toy struck him with the baseball bat and two other men wearing hoodies and bandanas kicked and punched him.
The defendants allegedly then fled from the scene.
The victim sought medical attention at Clarion Hospital.
Alexander Toy allegedly told police the group went to the apartment to rob the victim because “he was a drug dealer.”
Alexander Toy later denied making that statement but allegedly acknowledged he struck the victim with the baseball bat.
Alexander Toy allegedly told police Lamb sprayed the victim with pepper spray.
