A Kittanning man who attacked a Clarion man with a baseball bat was sentenced to serve up to two years in the Clarion County Jail on Wednesday.
Alexander M. Toy, 20, was one of five people who assaulted a man at his Clarion apartment.
According to court records, the victim was assaulted with the bat and kicked several times, causing him to “fear for his life.”
According to the documents, the individual struck him in the face and the back of the head with the bat, and he then fell to the ground, and was kicked and punched multiple times.
After the assault, the five individuals fled the area and traveled to Armstrong County, according to the documents.
Toy attended the sentencing hearing remotely from the Armstrong County Jail.
Clarion County Public Defender Jacob Roberts said this was the “type of action that was out of character for him (Toy) based on his previous history.” He said Toy was “just along for the ride that night” and that he “made some poor decisions that night.”
Clarion County District Attorney Drew Welsh said due to conflicting stories regarding the night of the assault, the “full truth” might never be known.
Judge Sara Seidle-Patton said this was a “deliberate, violent attack with a baseball bat” and that Toy made a “conscious decision.”
She sentenced Toy to serve nine months to one day less than two years in the Clarion County Jail. The sentence would run concurrent with his sentence in Armstrong County. He must also pay all costs and fines associated with the prosecution and undergo drug and alcohol counseling.
Also charged in the assault are: Tiffany Anne Lamb, 19, of New Bethlehem; Kierra Colligan, 20, of Ford City; Lucas Robert Toy, 18, of Kittanning; and Brandon A. Anthony, 19, of Kittanning.
