Man accused of killing roommate waives hearing

A Jefferson County man accused of shooting and killing his roommate waived his preliminary hearing Thursday.

William Joseph Sivak, 65, allegedly shot and killed his roommate, Amos Leroy Smail, 60, at about 8:30 a.m. May 10 at their residence at 732 Smail Road, Union Township, Jefferson County.

State police said they were notified of the shooting when Sivak called the barracks in Punxsutawney and told the communications officer he had “just shot a man” who was later identified as Smail.

Police said they found Smail’s body outside laying next to his pickup truck.

Police said Sivak told them he shot Smail in the living room of the dwelling and that after he was shot Smail walked from the living room outside to the driveway where he tried to unlock his truck.

Sivak said Smail collapsed in the driveway.

A criminal complaint said Sivak told police he shot Smail because he “couldn’t take him anymore and was tired of him (Smail) giving him a hard time.”

Sivak said he shot Smail with a .22 caliber rifle he kept in his bedroom, the complaint said.

Police said that when they were securing Sivak they found he was in possession of illegal narcotics including marijuana and paraphernalia.

Sivak remains in the Jefferson County jail.
