Brookville man gets probation in tortured deer case

A Brookville man accused of torturing a wounded deer last year has been sentenced to two years probation.

Jefferson County Judge John Foradora handed down his sentence last week after accepting a guilty plea from Alexander Brock Smith, 18.

Smith pleaded guilty to a misdemeanor charge of cruelty to animals and summary charges of drive or disturb game, taking or possession of game or wildlife, use of a device or method prohibited and violation of rules and regulations of the state Game Commission.

Several charges against Smith were dismissed as part of the plea agreement between Smith and the court. They included single felony counts of aggravated cruelty to animalstorture, conspiracy aggravated cruelty to animals-torture, two felony counts of aggravated cruelty to animals causing death, and two misdemeanors.

In addition to his two years probation, Smith was also ordered to perform 200 hours of community service and he must be available to the Game Commission to speak at hunting safety courses, schools and youth groups.

His hunting license was also revoked for 15 years.

A 17-year-old boy from Brookville was also charged in the incident. Information on juvenile cases is not available to the public.

Smith and the boy were accused of repeatedly kicking the wounded deer in the head and pulling off its antler in November. Video of the attack circulated quickly on social media and generated outrage, along with pressure on investigators to solve the case.

The Game Commission said in a criminal complaint that Smith and the juvenile boy were depicted in the video stomping on and kicking the deer’s throat and legs. The Game Commission also said the video showed the juvenile boy ripping off one of the deer’s antlers, according to the complaint said.

The juvenile told the Game Commission he was hunting on Smith’s father’s property in Beaver Township, Jefferson County, where he injured the deer with a single shot from a tree stand, the complaint said.

Smith wasn’t hunting and was unarmed, according to the complaint.
